The Apps for Library Idea Challenge (the “Challenge”) is a skill-based competition in which contestants are asked to come up with an original idea for a new application for use on the Elsevier SciVerse platform targeted to the needs of librarians and information specialists and the SciVerse users they support (“App Idea”). Those submitting eligible App Idea entries and commenter entries will also be entered in prize draws.
Please read these rules (the “Official Rules”) before entering the Challenge. By entering the Challenge, you agree to be bound by the Official Rules, and all the decisions of the Sponsor, and represent that you satisfy all of the eligibility requirements set forth herein.
The Challenge is open to individuals age twenty-one (21) years or older at the time of entry. The individual listed on the entry form will be the only person eligible to receive a prize, even if more than one person has contributed to the submitted App Idea. Entrants may be subject to rules imposed by their employer/institution relative to their participation in competitions or promotions and should check with their employer/institution for any relevant policies. Entrants are responsible for determining if the Challenge is legal in their jurisdiction of residence. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. Directors, officers and employees of Elsevier B.V. (the “Sponsor”), its parents, subsidiaries and affiliates, web design, advertising and promotional agencies, the Challenge judges, and the immediate families and those living in the same household of the foregoing are not eligible. Any App Idea, entry form, comment or other participation that violates these Official Rules, applicable laws or regulations, or participant’s employer’s/institution’s policies, will be deemed ineligible.
The App Idea entry period begins at 23:59:59 p.m. Central European Time (“CET”) on Friday, 13 May 2011, and ends at 23:59:59 p.m. CET on Friday, 2 September 2011 (the “App Idea Entry Period”).
All participants must register at the Challenge website at http://www.appsforlibrary.com (the “Challenge Site”) either by submitting a completed App Idea entry form during the App Idea Entry Period or thereafter by submitting a completed Challenge Site registration form available just prior to the Commenting Period. Registering on the Challenge Site will allow registered users to submit App Ideas, post substantive comments regarding Finalists’ entries, and vote on Finalists’ entries in the Community Prize voting, discussed below.
To submit an App Idea, during the App Idea Entry Period, users must visit the Challenge Site, click on the “Submit Idea” link, and complete the App Idea entry form providing all required information. Submission of the completed entry form will also register the entrant on the Challenge Site. The description of the App Idea in the entry form must be sufficiently clear and detailed to allow the Sponsor to readily assess the purpose, content, and utility of the proposed application. Entrants are encouraged, but not required, to include in their submission up to three (3) visual files (each file in .jpg, .png or .gif format and not to exceed .5MB) that further explain the App Idea. There is no limit on the number of App Ideas each entrant may submit, but each App Idea must be unique and submitted in a separate entry form. Entries that are (i) submitted in any manner other than as specified; (ii) submitted before or after the App Idea Entry Period; or (iii) incomplete or in any way not in compliance with these Official Rules will be disqualified. Sponsor’s servers and clock shall serve as the official clock for the Challenge and entrant’s proof of submission does not constitute proof of receipt by Sponsor. App Ideas and entry materials submitted through the Challenge Site become the property of the Sponsor and will not be returned.
All App Idea entries will be screened with regard to obvious intellectual property conflicts or any legal issues and whether they fall outside the target area of interest for the Challenge. All remaining eligible App Idea entries will be evaluated by a panel of qualified judges based on the following criteria:
The judges will select up to ten (10) Finalist entries, which will be posted on the Challenge Site on or about Monday, 26 September 2011. Sponsor reserves the right to select fewer than ten (10) Finalist entries if, in its sole discretion, Sponsor does not receive a sufficient number of eligible or qualified entries, or if Sponsor is otherwise unable to timely fill the Finalist slots for any reason. All decisions of the judges are final and binding.
All entrants who submitted eligible App Idea entries during the App Idea Entry Period will also be entered in a prize draw for one (1) Contributor Prize, described below. Each entrant will have one entry in the draw regardless of the number of App Ideas submitted.
Beginning on or about Monday, 26 September 2011, until 23:59:59 p.m. CET on Friday, 14 October 2011, the Finalist entries will be posted on the Challenge Site for review and comment by registered users of the Challenge Site (the “Commenting Period”). Registered users of the Challenge Site are invited to provide feedback on how to make the applications described in the Finalist entries better, more relevant, more buildable, or more broadly applicable, etc. All eligible participants who post a substantive comment on a Finalist entry, as determined in Sponsor’s sole discretion, will be entered into a prize draw for one of ten (10) Commenter Prizes, as described below. Limit one entry per commenting participant, regardless of the number of substantive comments posted. “Substantive” comments (“Comments”) are those addressing one or more of the judging criteria, determined in Sponsor’s sole discretion.
Beginning at 0:00:01 a.m. CET on 17 October 2011, and ending at 23:59:59 p.m. CET on 28 October 2011 (the “Voting Period”), registered users of the Challenge Site may vote for the Finalist App Idea they believe best reflects the judging criteria above. An explanation of the voting process and limitations on voting will be prominently posted on the Challenge Site prior to the Voting Period. The eligible Finalist App Idea selected by the community according to that voting process will win the Community Prize described below.
Also during the Voting Period, the Judges will select one (1) winner from among the Finalist App Ideas based on the judging criteria listed above to receive the Judges’ Prize, described below.
One (1) Community Prize winner and one (1) Judges’ Prize winner will each receive a €750 (approximately USD$1000) cash prize (issued in the form of a check made payable to each winner).
One (1) Contributor Prize winner will be selected in a random drawing held on or about 31 October 2011, from among all eligible registered users of the Challenge Site who submitted eligible App Idea entries during the App Idea Entry Period. The Contributor Prize winner will receive a Samsung Galaxy Tab 7” 16GB WiFi-only touchscreen tablet (approximate retail value: USD$349.99/€250).
Ten (10) Commenter Prize winners will be selected in a random drawing held on or about 31 October 2011, from among all eligible registered users of the Challenge Site who posted eligible Comments on the Finalist App Ideas during the Commenting Period, as determined by Sponsor in its sole discretion. Each Commenter Prize winner will receive a €35 (approximately USD$50) gift card from American Express.
Potential winners will be notified via e-mail at the e-mail address provided in the Challenge Site registration within ten (10) days from the close of the Voting Period. All potential winners must sign and return to Sponsor a Declaration of Eligibility and Liability/Publicity Release within 14 days of notification in order to claim the prize. If a winner: (i) is determined to be ineligible; (ii) cannot be contacted (for example, if the notice is returned as undeliverable); (iii) fails to return the completed Declaration of Eligibility and Liability/Publicity Release within 14 days of notification; or (iv) declines or waives the prize, or cannot or fails to accept the prize for any reason, then the prize will be forfeited and an alternate winner will be selected based upon the judging criteria in the case of the Judges’ Prize, based upon the voting in the case of the Community Prize, and in a random drawing from among remaining eligible entries in the case of the Contributor Prize and Commenter Prizes.
Limit one prize per person/registered user/e-mail address. Prizes will be awarded via mail to the name and address provided in the claim forms within 6 to 8 weeks following confirmation. Winners are responsible for payment of any local, state, or federal taxes applicable to winning the prize. No cash in lieu of prize. No substitution of prize, except that Sponsor reserves the right to substitute a prize of equal or greater value in the event a prize or prize component becomes unavailable for any reason. Winning App Idea entries will be posted on the Challenge Site on or about 14 November 2011, or as soon as the winners have been confirmed according to the process herein. All eligible App Idea entries submitted in the Challenge will be posted to the Challenge Site credited with the entrant’s name, role and country following the conclusion of the Challenge.
App Ideas, entries, and Comments submitted must be the original work of the participant submitting them. By submitting your App Idea, entry and/or Comment in the Challenge, you voluntarily forfeit all proprietary rights in the App Idea, entry and/or Comment and convey full ownership to Sponsor. App Ideas, entries and Comments submitted shall not: (i) violate the intellectual property rights (copyright, patent, trademark, etc.) of any third party; (ii) defame or invade the publicity or privacy rights of any person, living or deceased; (iii) be the subject of a patent or pending patent application; or (iv) otherwise infringe upon any person’s or entity’s personal or proprietary rights. Entrants are responsible for ensuring that Sponsor may use, develop, build, or otherwise publish their App Ideas, entries and/or Comments without the permission of any third party. Any entries found to be in violation of these provisions will be disqualified. Entries must not be obscene, profane, or unsuitable for publication in Sponsor’s sole discretion.
By submitting an App Idea and/or Comment in the Challenge, entrants understand and agree that, as the owner of all rights in the App Ideas, entries, and Comments submitted, Sponsor may post, publish, display, use, reproduce, distribute, edit, translate, exploit, and create derivative works from the App Ideas, the entries (including any visual materials), and any Comments for any commercial or non-commercial purposes in any manner and in any medium now known or hereafter devised throughout the world in perpetuity without restriction and without further obligation to entrants or any other party. Entrants agree and understand that Sponsor may choose to build, or not to build, and allow others to build applications based on the App Ideas. Entrants agree and understand that Sponsor will make all eligible App Ideas and Comments to the Finalist App Ideas available to the SciVerse Applications Developer community at large, so that others may use the App Ideas and Comments in building applications in future projects without restriction by or further obligation to entrants. By submitting an App Idea or Comment on a Finalist App Idea in the Challenge, participants specifically agree to such use. Participants agree not to instigate, support, maintain or authorize any action or lawsuit against Sponsor and/or its affiliates, or any of their employees, officers, directors, or agents, on the ground that any use or development of their App Ideas, entries or Comments infringes any of their rights as creators of such App Ideas, entries, and Comments.
By entering the Challenge and by submitting App Ideas and Comments on the Challenge Site, participants grant Sponsor and its affiliates, the rights, without limitation or further permission or compensation, to use, display and publish their name, role and country, with or without their App Ideas, Comments or other entry materials, on the Challenge Site and in connection with any references to or discussions of the Challenge in any media. Winners’ full names, role and country, as well as their App Ideas, entries and any Comments made relating to their App Ideas, may be featured on the Challenge Site and websites of the Sponsor and its affiliates and in printed and online publications. Participants hereby forever waive and relinquish all so-called “moral rights (droit moral)” now or hereafter recognized in the App Ideas, entries and Comments.
Notwithstanding anything to the contrary contained in these Official Rules or elsewhere, Sponsor makes available the Challenge, the Challenge Site, and any prizes on an “as is” basis and disclaims all warranties, including any warranties of merchantability and fitness for a particular purpose in connection therewith. Sponsor and its parents, subsidiaries, affiliates, agents, professional advisors, advertising and promotional agencies, and directors, officers, and employees thereof, shall not have any obligation, liability or responsibility for: (i) lost, late, incomplete, illegible, unintelligible, damaged, garbled, or misdirected entries, comments, votes, prize claims, notifications, or other communications; (ii) inaccurate entry information, whether caused by participant or by any of the equipment or programming associated with the Challenge; (iii) any errors or malfunctions that may occur; (iv) any condition caused by events beyond Sponsor’s control that may cause the Challenge to be delayed, disrupted or corrupted; (v) any error in any materials associated with the Challenge; and (vi) any damages or losses of any kind resulting from participation in the Challenge, accessing, transmitting, uploading or downloading data in connection with the Challenge, or acceptance, possession or use of any prize. Any use of robotic, automatic, macro, programmed or like entry or voting methods is strictly prohibited and will result in the disqualification of any entrant or registered user using such methods and the voiding of any votes generated by such methods, in Sponsor’s sole discretion.
BY ENTERING THE CHALLENGE REGISTERING ON THE CHALLENGE SITE, AND/OR SUBMITTING COMMENTS AND/OR VOTING ON FINALIST ENTRIES, PARTICIPANTS RELEASE AND HOLD HARMLESS SPONSOR AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS, PROFESSIONAL ADVISORS, ADVERTISING AND PROMOTIONAL AGENCIES, AND DIRECTORS, OFFICERS, AND EMPLOYEES THEREOF, FROM ANY AND ALL CLAIMS, INJURIES, LOSS, DAMAGE, EXPENSES, OR LIABILITIES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE CHALLENGE, PARTICIPATION IN THE CHALLENGE (INCLUDING PROVIDING COMMENTS AND VOTING), OR DELIVERY, MISDELIVERY, ACCEPTANCE, POSSESSION, AND USE OF, OR INABILITY TO USE, ANY PRIZE, TO THE EXTENT PERMITTED BY LAW. IN NO EVENT WILL SPONSOR BE LIABLE TO A PARTICIPANT FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF, OR IN CONNECTION WITH THE CHALLENGE, WHETHER OR NOT SPONSOR HAS BEEN ADVISED, HAD REASON TO KNOW, OR IN FACT KNEW OF THE POSSIBILITY OF SUCH DAMAGE.
The laws of the Netherlands govern the Challenge and these Official Rules. Participants irrevocably consent to the exclusive jurisdiction of the courts of The Netherlands with respect to any action or suit arising out of or pertaining to the Challenge and these Official Rules (except where local law requires).
If for any reason, the Challenge is not capable of being run as planned, the Sponsor reserves the right in its sole discretion to change these Official Rules, disqualify any individual who tampers with the entry or voting process or operation of the Challenge Site, and to modify, suspend, cancel or terminate the Challenge. If the Challenge is terminated early, the Sponsor may select Finalists and winners based on the App Ideas and Comments received prior to the termination date or take any other action in its sole discretion to carry out the letter and spirit of these Official Rules.
Participants agree to be bound by these Official Rules and the decisions of the Sponsor in regards to the Challenge. Any participant found to be acting in violation of these Official Rules may be disqualified in Sponsor’s sole discretion. In the event of a dispute regarding the identity of a winner, the winner will be the individual registered user named in the Challenge Site registration through which the App Idea or Comment was submitted.
Neither Samsung nor American Express is a sponsor or participant in the Challenge or makes any endorsement of the Challenge.
The names of the winners will be posted on the Challenge Site for at least thirty (30) days after the winners are selected, along with a copy of these Official Rules.
